We are a virtual law firm and therefore don’t handle contested cases, but we can refer you to a qualified California lawyer who does. Please note that we can only legally represent one party in the case, as representing both parties would be a conflict of interest in the State of California.
Mediation for California Residents
Mediation is a way of resolving disputes without resorting to legal action. A neutral third party, the mediator, facilitates discussion between the parties in an attempt to reach an agreement that they are both comfortable with. Reaching an agreement privately between the parties is often far more cost-effective than pursuing litigation. Most types of dispute are suitable for resolution via mediation. If mediation fails, the litigation route remains open.
Attorney Daniel Weiner has been trained as a mediator by renowned expert Carl D. Schneider. To keep fees as low as possible, all mediation sessions for our California clients are conducted via internet video conferencing. This enables you to engage in mediation from the comfort of your home or while you are traveling. We offer a free initial telephone consultation to discuss your needs.
California Estate Planning
It is important for everyone in California to consider having an estate plan. Even those without vast wealth need to consider how to plan for what happens to their property after they pass away. They also need to plan for and state their wishes regarding certain other major events that could take place during their lifetime. Estate planning encompasses a broad range of issues and documents:
- Wills: specify how your assets should be divided when you pass away. Otherwise, they will be divided in accordance with California's default laws, which may be different from what you intend.
- Living Trusts: these have become a popular estate planning tool in California. Essentially, you place property into a trust that takes effect during your lifetime. Crucially, you retain control of the property while you are alive, and you can amend the terms of the trust for as long as you are alive. The Living Trust is often combined with a will.
- General durable power of attorney: this gives another person the right to make financial decisions on your behalf. It continues to be effective even if you become incapacitated.
- Advance health care directive: this gives another person the right to make medical decisions on your behalf if you become incapacitated. Without one, decisions about your medical care may be made by someone who you would not have chosen if you could have made that choice for yourself.

Fixed fees range from $295 to $595 depending on the contract to be drafted. Beware of free legal forms sites like Legal Zoom. Documents downloaded from those sites are not prepared by a lawyer. In my experience, those documents often contain problematic legal provisions that would not have been included if a lawyer had prepared them.
